Health and Performance Nutrition Coaching

By accepting these terms, I understand and consent we are committing to a health, wellness, and nutrition plan. I will not hold Services with Wendi INC (Wendi Irlbeck, MS, RDN, LD, CISSN) or her team of registered dietitians responsible for any injury, illness, allergic reaction, or lack of results while engaged in nutrition coaching or fitness coaching or at any time in the future.

I acknowledge that Wendi Irlbeck, MS, RDN, LD CISSN, and employees are NOT physicians, physiologists, or pharmacists. Services with Wendi are NOT providing medical advice or prescribing treatment. I understand that I will be coached by a registered dietitian who will refer me to the necessary medical professional if questions are beyond the scope of practice.

As a client, I understand that I am simply receiving guidance and education to enhance my knowledge of health, and nutritional sciences as it relates to foods, dietary supplements, and behaviors associated with eating, and/or exercise. My participation in this program is voluntary, and by signing this waiver I accept responsibility for any harm, injury, illness, or death that may result from my participation.

I understand that it is my responsibility to consult with my physician and pharmacist before changing my medications or altering the dosage. I hereby affirm that I am in good physical condition and do not suffer from any mental or physical disability that would prevent or limit my participation in a program provided by Nutrition with Wendi. I understand that I can discuss any dietary changes or potential dietary supplements use with Wendi Irlbeck, MS, RDN, LD, CISSN but must consult with my pharmacist or physician on any changes suggested.

I will communicate my goals with the dietitian I am working with upfront. I understand that results take time and that I must follow a plan in order to achieve change. I the client understand the process of behavioral change and will not hold my dietitian at fault if I myself am not committed to following the plan that is provided.

I acknowledge that the advice and knowledge that I receive as part of my nutrition and/or fitness coaching program is separate from the care that I receive from any medical facilities/agents in that the nutrition coaching sessions are in no way intended to be construed as medical advice or care. I understand that I should continue regular medical supervision and care by my primary care physician.

I understand that as part of a fitness coaching program, I will be participating in a program of strenuous physical activity including but not limited to walking, hiking, running, swimming, biking, resistance training, weight training, cardiovascular exercise, and the use of conditioning and exercise equipment. I also acknowledge that I will take part in this physical activity of my own volition.

I expressly assume the risks involved with a nutrition and/or fitness coaching program, including the risks of trying new foods, trying new exercises, and the risks inherent in making lifestyle changes.

I fully understand that I may suffer injury and even death as a result of my participation in the fitness and/or nutrition coaching program and I hereby release Services with Wendi INC. from any and all liability now and in the future, including but not limited to medical expenses, lost wages, pain, and suffering that may occur by reason of heart attacks, muscle strains, muscle pulls or tears, broken bones, shin splints, heat prostration, knee/lower back/foot injuries and any other illness, soreness or injury, however, caused, whether occurring during or after my participation in the program regardless of fault.

I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Nutrition with Wendi from any and all liability, claims, damages, demands, or causes of action, that are in any way connected with my past, present, or future participation in Nutrition with Wendi nutrition coaching or fitness coaching program, including such claims which I, my children, parents, heirs, assigns, personal representative and estate have or may have that allege ordinary negligent acts or omissions of Nutrition with Wendi.

Any advice regarding dietary supplements provided by Services with Wendi INC is strictly done so in theory only, and these products may not have been approved by the FDA. Any companies or products mentioned by Nutrition with Wendi are not affiliated with Wendi Irlbeck, MS, RDN, LD, CISSN and The Nutrition with Wendi staff is not liable for any negative repercussions associated with the consumption of any aforementioned product or service.

I understand and agree to work with any NWW dietitian or coach. I give permission to Wendi or her team to lead sessions and provide resources and support.

Payment, scheduling, and communication

Cancellation Policy

A 48-hour notice is required for all cancellations and rescheduled sessions. With such notice, Nutrition with Wendi is able to schedule someone else in your time slot. Nutrition with Wendi will charge 50% of the service or you will surrender your check-in you scheduled for any appointment if it is canceled without the 48-hour notice. We appreciate your understanding and cooperation. NO REFUNDS.

Communication

Communication between email and text is available between sessions. We do ask for a courtesy of questions to be directed to Google Drive so we can answer them but if you have a quick question we can answer it within the business hours listed below.

Added sessions beyond the agreed-upon consultation and 2 monthly family sessions can be added at a rate of $90 per 30-minute session for extra support.

Coaches are available Monday-Friday at 9 am CST.-5 PM CST. Saturday 10 am CST- 12 PM CST to answer quick questions between sessions via email or text for those that are enrolled in the aforementioned specialty programs (we can respond within 48 hours).

If a medical emergency arises please call 911.

We are Unavailable on Sundays. You are welcome to leave me a message, email or text, and I will return with a response during the hours of this contract.

**Sessions that are not rescheduled within 48 hours are charged in full.

**Sessions for the package will be booked at the first initial visit for the duration of the time of

the contract.

**Payments are to be made in full unless otherwise specified with a monthly payment plan only

available to ongoing coaching with a minimum of 3 months commitment.

*I understand that failure to reschedule my appointment within 48-hour notice via the Square

scheduling system is forfeiting the session. I understand that sending an email or text to Coach Wendi after hours on a Saturday night or Sunday is not how I reschedule my appointment unless there is a technical reason.

Payment scheduling

The initial payment is due upon enrollment, and each subsequent monthly payment will be automatically billed to my saved payment method.

I am responsible for delivering payment on a recurring basis for any services provided by Services with Wendi INC. I also acknowledge and consent that there are no refunds for payments made to Services with Wendi INC

Services

All services are provided over ZOOM!

*Weekly or bi-weekly 30-min check-ins with a NWW coach

*Individual plan with custom kcal, protein, carbs, fat, and nutrient timing designated for sport. The client will have a Google Drive with a folder to house meal plans, calories, macros, and exercise guidance written out and clearly identified for each to access via Google Drive. The client agrees to upload any labs, DEXA scan, and health Hx for a dietitian to review with the client.

*Client will agree to log nutrition and review on the call with the dietitian as part of the process.

Nutrient logs and understanding energy input and output is essential to the success of our

program.

*Grocery store/pantry discussion included during home consultation.

*Ebooks, recipes, resources on demand

These sessions will be held monthly over Zoom. You will communicate via email, google drive QA, and text per designated hours with the NWW dietitian to establish a positive and professional client/provider relationship.

Scheduling

All follow-up sessions will be booked in advance on a regular repeating schedule to avoid conflicts.

-Text/email/video support is included. If you wish to have your dietitian record questions you

have and send to you in place of a check-in session that can replace a check-in.

Early Termination Option
You have the option to end this agreement early by paying a $500 buyout fee. This option is only available if you have two months or less remaining on your contract.

*I the client understand to respect the professional conduct and will not communicate in a way that violates the professional code of conduct. If at any time the client or the provider coaching the client feels uncomfortable immediate contract termination will result in no refund.
